Agreement Between City of Rapid City and First Nations Sculpture Garden Inc.
for Sculpture Garden in Halley Park

Summary:
|
The
Parks and Recreation Advisory Committee considered the MOA at its meeting on
July 11, 2013 and voted not to recommend that Council approve of the MOA.
Since that time, the MOA has been revised to include a provision that First
Nations’ failure to begin construction of the sculpture garden within three
years of the date of the MOA means that the rights and obligations under the
Agreement will expire and the Agreement will terminate.

If
the sculpture Garden is constructed, the City will provide general
maintenance of the garden of the same sort it currently provides for Halley
Park, during the term of the Agreement.

The Parks and Recreation Advisory Board voted 4-3 to recommend denial of the
proposed Memorandum of Agreement at the Halley Park location and strongly
recommend that First Nations work with Parks and Recreation staff to find a
better location for this project.
